E-Sign Consent
Consent to Electronic Signatures, Records and Disclosures ("E-Sign Consent")
Introduction. Improvemint Financial, a dba of Own.lease, Inc. ("we", "us", "our"), offers customers the ability to receive, review, sign and retain agreements and disclosures electronically. This consent to electronic signatures, records and disclosures ("E-Consent") explains your rights when receiving or giving electronic disclosures, notices, information and communications (together, "Disclosures"). Disclosures may include notices required by federal or state law and other information. By affirmatively selecting the electronic consent option during the application process, you consent to receive applicable records electronically and to use electronic signatures for transactions covered by this E-Consent. Simply emailing, texting or contacting customer support does not constitute acceptance of this E-Consent.
Paper copies. You may request a paper copy of any Disclosure provided electronically by contacting us at the email address or phone number below. We provide paper copies at no charge. We keep all Disclosures as required by law.
Scope of consent. This E-Consent applies to all Disclosures and to all of our transactions and interactions with you, on any computer, electronic or mobile device, including phones, smartphones, fax machines and tablets. Under this E-Consent we may process your information, interact with you electronically, store your Disclosures electronically and send you any notices, including Disclosures, electronically.
Hardware and software requirements. To access and keep Disclosures electronically you need: a device with internet access; a current web browser that supports secure connections (TLS); an email account; and software that opens PDF files. To keep copies, you need a printer or storage on your device or in a cloud service. We do not provide internet service. If these requirements change while you have an active relationship with us, and the change creates a material risk that you cannot receive Disclosures electronically, we will notify you.
Withdrawing consent. You may withdraw this E-Consent at no charge by contacting us at the email address or phone number below. Withdrawing before you receive our services may prevent you from receiving some services from us. Withdrawal does not affect the legal effectiveness, validity or enforceability of Disclosures already provided electronically.
Keeping your contact information current. To request paper copies, ask about hardware or software, withdraw your consent or change your contact information, contact us using the details below. You agree to tell us about new contact information at least 5 days in advance. If you have not told us of a change in time, you agree that we may use the contact information we have on file.
Email and mobile phone consent. We may use the email address and mobile phone number you provide to communicate with you regarding your lease application, account, transactions and customer support. Consent to receive electronic records does not automatically constitute consent to receive promotional communications.
Your ability to access Disclosures. You agree that you can access Disclosures in the formats described here. We send copies of your Disclosures to the email address you give us, and you can request them again at any time.
Transferable records. Unless a later agreement with us expressly says otherwise, any agreement you sign with us is not intended to be a "negotiable instrument" as defined in the applicable Uniform Commercial Code and is not governed by its Article 3. Our agreements with you are "transferable records" to the extent permitted by, and as defined in, applicable law on electronic transactions. If a court finally decides that an agreement with us is not a "transferable record" under applicable law, the electronic chattel paper provisions of Article 9 of the applicable Uniform Commercial Code apply to it. The electronic copy of the agreement in the document management system we use to store it is the single authoritative copy. The holder of the agreement, as identified in that system, may assign and transfer the registration of the agreement to an assignee, who becomes the new holder, under the transferable record provisions of applicable law or the electronic chattel paper provisions of Article 9 of the applicable Uniform Commercial Code.
Governing law. Vermont law governs this E-Consent, except that the Federal Arbitration Act governs the Jury Trial Waiver and Arbitration Clause.
Electronic records and access. By agreeing electronically, you confirm that you are accessing electronic records in electronic format, that you can use your own device and internet connection to review Disclosures, and that you can open files in the formats we use, such as PDF and HTML.
Delivery of electronic Disclosures. Electronic Disclosures may be delivered by email or made available through a secure electronic document system, as permitted by applicable law. Where required, we will provide instructions for accessing, downloading and retaining those Disclosures. You may request paper copies by contacting Improvemint Financial using the details below.
You are not required to transact electronically. You do not have to accept electronic Disclosures or records. If you cannot access Disclosures electronically, or you prefer paper, tell us before you agree and we will provide them on paper.
Consent. By affirmatively selecting the electronic consent option during the application process, you agree to these terms, confirm that you have read this information, and consent to electronic signatures, Disclosures and records and to transacting electronically.
